Aaron Mitchell, JD, Esq

Founding and Managing Member
Former Prosecutor
Trial Attorney

Aaron was raised in Montana, where he spent most of his time fishing and enjoying all the Big Sky country has to offer. Aaron obtained his bachelor's degree in Sociology with an emphasis in Criminology and a professional certificate in Forensic Sciences from the University of Montana. During his undergraduate studies, he attended a year at the University of New Mexico through the National Student Exchange Program, where he interned for a semester with the Victim's Advocate Division at the 2nd Judicial District Attorney's Office. He then attended law school at the University of Idaho, where he completed a summer externship in Albuquerque working on felony criminal cases in the General Crimes Division at the 2nd Judicial District Attorney's Office. After passing the Bar Examination in New Mexico, Aaron accepted a position with the 2nd Judicial District Attorney's Office as a criminal prosecutor. During his time as a prosecutor, Aaron has handled a wide range of cases, including domestic violence, DWI, traffic offenses, and other misdemeanor and petty misdemeanor offenses. After gaining an insightful familiarity with the criminal justice system as a state prosecutor, Aaron took the initiative in founding Mitchell Law Offices, LLC with the distinct vision of providing New Mexico's communities with personable and reputable criminal defense as well as restraining order defense.

The Cost of Procrastination:

When faced with a criminal accusation, it is crucial to resist the "wait-and-see" approach and seek legal representation immediately. Criminal cases are fast-paced and complex, and the state or city prosecutor will not stop their prosecutorial efforts against you just because you are unrepresented. Unfortunately, the criminal charge you are facing will not go away by simply waiting it out to see what happens. The only way to successfully contest a criminal accusation is by answering for your charges in the court of law. Waiting to retain legal representation will only allow the state or city an uncontested head-start in the prosecution of your case. By immediately obtaining the assistance of an attorney, you can prevent the state or city from gaining such an unfair advantage over you and your case. Promptly retaining counsel will also allow your attorney adequate time to thoroughly review the case the state or city has built against you and devise a strong legal defense based upon the evidence and applicable statutory and case law. Don't be the person who hands the state nor city the keys to their own jail cell. Causing delay in your case without representation can, and very likely will, cost you dearly. Some further examples include:

1. Time is not on your side:
Delay in retaining counsel could result in the presiding judge adding time to the prosecutor's statutory limitation on the number of days the prosecutor has to bring your case to trial. This avoidable result would give the prosecutor more time to aggressively prosecute your case.

2. Evidence can be lost or destroyed:
Good defense attorneys build a strong legal defense for their clients by holding the state or city accountable to applicable statutory and constitutional rules and regulations. However, the best defense attorneys are also proactive in their work and engage their investigative skills to collect any evidence that could vindicate their clients of their accusation or mitigate any potential consequences. Because digital and physical evidence that may be favorable to your defense can be lost or destroyed, it is crucial to quickly retain your attorney of choice to avoid such a risk.

3. Delay can affect your case:
A good attorney will know and understand the state and local rules of criminal procedure applicable to the court in which your case is brought before. Criminal prosecution is fast-paced and riddled with important deadlines that must be met by one or both parties. Some of the most important procedural deadlines expire within the very early stages of prosecution. Without a skilled attorney, you run the risk of handing the prosecutor a "freebee" if they are not in compliance with court rules and procedural deadlines because you may not know to raise the issue in court. More importantly, if you miss a defense deadline, you run the risk of causing your case irreparable harm.
